GREENWOOD, Ind. – Greenwood is a small town in the state of Indiana. A jury has found a 23-year-old Greenwood man guilty of shooting his girlfriend in the face after she refused to give him her stimulus money so he could buy more guns after a week-long trial.
Darius Birk listened to the jury deliver their judgment on all counts of attempted murder, aggravated battery, pointing a firearm, and carrying a handgun without a license on March 7, following three hours of deliberation.
On his own, Birk faces up to 40 years in prison for attempted murder. The date for the sentencing hearing has been set for April 22.
The allegations arose from a shooting that occurred on March 13, 2021, in the 600 block of Park Drive in Greenwood, where witnesses reported hearing a gunshot, according to court filings. Following the shooting, the victim was found at Community Hospital South, where Birk had driven her.
The woman had a severe gunshot wound to her mouth and lower jaw, according to authorities, and could only nod or shake her head in response to queries.
When the victim was able to talk again a few weeks later, she informed investigators that she and Birk had been arguing previous to the shooting because he demanded the $2,800 in stimulus money she was anticipating. According to court records, Birk wanted to buy guns with the money, while she wanted to spend it on her two children.
When the disagreement turned heated, Birk punched her in the face while she was driving. The victim ultimately came to a halt and ordered that Birk exit her van. Birk then pulled out the revolver he was carrying illegally and shot her in the face.

Witnesses said they heard the woman scream and Birk tell her to get back in the van. According to court filings, Birk allegedly drove the woman about for a few minutes before choosing to take her to the hospital.
