A Texas Man Who Fatally Shot His Girlfriend’s Ex-husband Will Not Face Criminal Charges.


The Texas Attorney General announced that a man who shot and killed his girlfriend’s ex-husband while the estranged couple argued over child custody will not face criminal charges because the shooting was in self-defense.

William ‘Kyle’ Carruth, 39, shot Chad Read, 54, in Lubbock on November 5 after the two squared off and wrestled over a gun.

Carruth will not face charges after a special grand jury determined the argument occurred on his property and the shooting was self-defense, Attorney General Ken Paxton said on Thursday.

Carruth, the ex-husband of 72nd District Court Judge Ann-Marie Carruth, was never charged with the shooting, which his attorney argued was a ‘justifiable homicide’ committed in self-defense.

The argument that culminated in the shooting was about a custody battle between Chad Read and his ex-wife Christina, who was dating Carruth.

Carruth will not face criminal charges for fatally shooting his girlfriend’s ex-husband during a child custody dispute, a Texas grand jury determined, because the argument occurred on his property and was carried out in self-defense.

Jennifer Read will now file a $50 million wrongful death lawsuit in civil court following the conclusion of the criminal investigation.

‘It appears that it is acceptable in Texas to bring a gun to a verbal altercation and murder the ex. ‘The’special’ grand jury was a sham,’ she stated on Facebook.

‘Aside from myself and Chad’s mother, I am unaware of anyone else who testified for Chad. They did this to avoid being inundated with calls and to claim responsibility, but I guarantee they were not present for Chad Read.’

According to the Lubbock Avalanche-Journal, the Lubbock County District Attorney’s Office recused itself from the investigation due to Carruth’s connection to the judge.

The investigators turned over their findings to the Texas Attorney General’s Office, which prosecuted all charges in the case.

‘The case was presented by several eyewitnesses, Chad Read’s family, and additional evidence that had not previously been made public,’ Paxton announced.

‘Following several days of exhaustive examination of the evidence, the Special Grand Jury concluded its investigation and deliberated on whether the evidence supported the filing of criminal charges against Kyle Carruth.

‘Today, the Special Grand Jury decided not to indict Kyle Carruth on any criminal charges.’

Judge Carruth divorced Kyle shortly after the shooting, despite the fact that she lost her re-election bid in March and will remain in office until December.

According to an affidavit filed in their then-ongoing divorce case, she had been ‘notified that my husband…is under investigation for shooting and killing the father of his girlfriend’s children as he attempted to pick them up.’

‘The criminal justice system completely failed Jennifer Read, Chad Read’s widow,’ Jennifer’s attorney stated following the AG’s statement.

Her attorney contended that Chad was embroiled in a heated argument with Christina and that Kyle Carruth intervened.

‘We believe Kyle Carruth had no legitimate reason to bring a lethal weapon to an argument he was not even a part of. Chad Read was shot and killed while attempting to locate his son,’ Jennifer’s lawyer, Tony Buzbee, told Law&Crime.

‘The civil case has been placed on hold pending the outcome of the criminal case. We will now vigorously pursue Jennifer Read’s civil claims.’

Jennifer Read was also seeking custody of Chad Read’s children, ages 9 and 14.

‘They are aware that Kyle Carruth murdered their father in front of their mother, stepbrother, and me,’ she argued in court filings last year.

In January, a judge denied her petition for custody. Her lawyer stated that she will be unable to sue again because Chad Read’s prior lawsuit was dismissed following his death.

‘Under Texas law, one of the children’s blood relatives must file suit to obtain custody of the children, and Mrs. Read is heartbroken that no family member has yet stepped forward to protect these children,’ her attorney stated.

Jennifer captured Chad’s final moments from a car parked on the street outside Kyle Carruth’s South Lubbock home, where she captured Chad arguing with his ex-wife and Carruth.

According to the mobile phone video, Chad Read and Kyle Carruth were arguing on the house’s porch, with Christina Read to the right.

Kyle Carruth was overheard ordering Read to ‘leave my property.’ Chad Read made a motion with his arms as Carruth turned to enter the house.

Read then turned around and continued speaking with his ex-wife, telling her that he desired custody of his son, whom he was supposed to have custody of beginning at 3.15pm that day, according to Jennifer in an affidavit filed following the incident.

‘I apprehend him at 3.15. If you wish to see him, you may do so until 3.15 p.m. If you continue to attempt to keep my son from me, I will drag you, Ann-Marie, and everyone else into court,’ he stated.

Carruth then reappeared from the house, brandishing a gun and yelling at Read to ‘leave’.

Carruth fired one shot into the floor at the pair’s feet, which appeared to have no effect on Read, who continued to push Carruth.

Carruth then leapt off the porch, raised the rifle, and fired two shots at Chad, who collapsed to the floor.

Following the shooting, Jennifer Read accused Christina Read and Kyle Carruth of plotting to assassinate her late husband, claiming Chad Read possessed evidence of the couple’s affair and threatened to make it public.

‘Despite Kyle Carruth’s marriage, Christina Read and Kyle Carruth have been having an ongoing affair,’ she stated in an affidavit last year.

‘On October 30, 2021, Chad Read informed Christina Read that he had evidence of her affair with Kyle Carruth and that he was going public with it,’ the affidavit continued.

Jennifer also suggested that Carruth and Christina Read plotted against Chad Read, citing specific moments in the video as evidence.

Carruth’s lawyer stated last year that the shooting was justified, citing the Castle Doctrine, a Texas law that allows someone to ‘defend himself, others, or his property.’

A special grand jury agreed Thursday not to indict him on any charges.
